Highlights from the September 13, 2022 Board of Supervisor’s Meeting
The morning session September 13 , 2022 Board of Supervisors meeting opened with a moment of silence and the Pledge of Allegiance followed by public comments mostly addressing safety issues on Route 151 and other roads in Nelson County. The minutes of the June 14 and June 27, 2022 were approved with one minor correction.
A budget amendment was approved correcting a clerical error in the previously passed Budget Amendment Reflecting the Transfer of Funds (General Fund Non ((Word”Non” previously omitted)) -Recurring Contingency) totaling $36,765.68 (total having been omitted).
The Board passed Resolution R2022-51 to support the nomination of the Blue Ridge Tunnel for recommendation to the National Register of Historic Places and for inclusion in the Virginia Landmarks Register.
The Board passed Resolution R2022-52 to permit the Millenium Group to lease for a 5 year term a portion of its real property to the Nelson Department of Health and the County will honor the lease in the event that the underlying real estate reverts to the county because the that portion of the property is no longer being used as community center or for recreational purposes.
The Board passed Resolution R2022-53 to support the request of the Albemarle-Charlottesville Regional Jail authority that the Board of Local and Regional Jails gives it approval for the Community Based Corrections Plan Needs Assessment and Planning Study and funding for reimbursement of 15% of all eligible costs subsequent to Governor and General Assembly approval and funding relative to the expansion and renovation of existing space as identified in the Community Based Correction Plan Planning Study submitted to the Board of Local and Regional Jails pursuant to Section 53.1-81 of the Code of Virginia (1950) as amended.
The Board passed Resolution R2022-54 and directed the County Administrator/Clerk of the Board of Supervisors to submit the required notification letter to DHDC within the prescribed timeframe effecting the release of Charles Miller as Building Code Official and appointing Assistant Code Official, James Allen as acting Building Code Official until such time as a permanent Build Code Official is appointed.
VDOT gave a report on general construction and maintenance of the roads in Nelson County. Mr. Reed raised that issues he had raised at the August meeting had not been satisfactorily address and Mr. Parr raised two additional maintenance issues. Rick Youngblood gave a power point on behalf of VDOT AND RK&K presentation about the 151 Corridor Study from Route 6/ Route 638 to 2.3 miles south of Route 644. The study area encompasses Route 151 at Route 6/Route 638 , Route 151 at Route 840, Route 151 at Route 635 (Greenfield Road). Route 151 at Route 635 ( Rockfish School Lane), Route 151 at Route 6 (River Road) . Route i51 at Wintergreen Main Entrance, and Route 151 at Route 644 (Beech Grove Road) .The Spring and summer traffic counts have been collected. The operation and Crash analysis is to be completed in September 2022, the NO-Build & Build 2045 Operational Analysis will be conducted from October 2022 to April 2023, with recommendations being drafter between December of 2022 to April 2023 on the issues of
a) Intersection improvements
b) Corridor safety improvements
c) Review of Nellysford for bike/pedestrian improvements and traffic calming
d) Corridor multi modal strategies .
The report with concept designs and estimates consistent with Smart Scale requirements should be made in May of 2023 and the project should be concluded in the summer of 2023. Five Study Work Group meetings will be scheduled and 2 public in person outreach meetings including
one session following the exiting conditions analysis (October 2022) and one session to present future Build analysis in March of 2023.
David Blount the TJPDC 2022 Draft legislative report which focused on directing federal and state funds to recovering communities and advocation for statewide broad band access.
Ted Reick gave the annual report on Jaunts routes and service provided and discussed what would need to occur to expand services to the southern part of the county especially for those seeking services in Amherst County.
Architectural Partners presented their report on the feasibility of the Agricultural Complex with drawings and costs. Depending on which plan is chosen, the land cost is $1,200,000, the site work is $28,288,703 structures are $23,681,720 for a total construction cost of $53,300,000. If the Alternative Plan additions is adopted with Cowboy/RV Camping sites at the Fairgrounds, the total construction cost is $53,800,000.
The Board voted in favor of changing the date of the November from the 8th to the 7th (R2022-55).
The Board voted affirmatively o include Nelson County in the grant application Safe Streets and Roads for All Grant Program (20% paid by the county not to exceed$30,000).
The Board voted affirmatively to permit the Lovingston Volunteer Fire Department an emergency interest free $40,000 loan to purchase a 2005 HME Fire Engine to be added to the approximate $47,000 current loan, This is needed to replace a 1995 Engine with serious mechanical difficulties. Mr. Harvey was the one dissenting vote.
The Board voted to schedule the Proposed Amendment to K-9 At Large Ordinance ((R2022-56) for October 11, 2022 at the General District Courthouse at 7:00 pm for a public hearing so as to permit two notices to be issued prior to the meeting. Sergio Sanchez was appointed to represent South District on the Nelson County Service Authority. The former representative, Gary L Sherwood resigned.
At the 7:00 pm hearing, the Board took up the request of Chris LeBlanc and Rachel Horveth for a special use permit to construct a vacation house in a R-1 Residential district located on Afton Mountain Road on 10.334 acres. The Special Use Permit was approved, by a vote of 3-1. Mr. Harvey voted no. Mr. Parr was not present.
